Terms of Use

These Terms of Use govern access to and use of the Guilietta platform. Please read them carefully. They are written in plain language because we believe you should understand exactly what you are committing to.
1. Acceptance of the terms
By creating an account or using Guilietta, you fully accept these Terms of Use. If you do not agree with any part, you cannot use the service. These terms form a binding agreement between you and Guilietta.
2. Service status
The service may present errors, interruptions or unexpected changes. We do our best to keep it stable, but we do not guarantee uninterrupted availability. By accepting the terms when registering, you acknowledge this state of the service.
3. Eligibility
General requirements and by jurisdiction:
- ·Minimum age (general): 18 years.
- ·European Union / EEA / United Kingdom: 16 years with verifiable parental consent.
- ·If your country's local legislation sets a different minimum age, the higher of that age and 16 years applies.
- ·You must provide truthful and up-to-date information when registering.
- ·You are responsible for maintaining the confidentiality of your password.
- ·Only one account per person is allowed.
- ·By registering you declare under your responsibility that you meet the applicable minimum age. Guilietta does not currently implement an active age-verification mechanism.
4. Acceptable use
You may use Guilietta to:
- ·Analyze your own conversations to identify risk patterns.
- ·Activate safe travel mode and share your location with your trusted contacts.
- ·Manage your emergency contacts.
- ·Access support and personal safety resources.
5. Prohibited use
It is strictly prohibited to:
- ·Analyze conversations of third parties without their explicit consent.
- ·Use the service to harass, monitor or harm other people.
- ·Attempt to access accounts or data of other users.
- ·Reproduce, sell or distribute any part of the service without authorization.
- ·Use the service for illegal purposes or contrary to public order.
- ·Overload the system through unauthorized automated use.
6. Conversation analysis
The conversation analysis service uses artificial intelligence (Anthropic and, as a fallback processor, OpenAI) to identify possible risk patterns. Content is processed transiently: the processor may retain it only for a short abuse-monitoring window under its data processing agreement, and does not use it to train its models. The conclusions are indicative and do not constitute legal, psychological or professional safety advice. Important limitations:
- ·The analysis may produce false positives (identifying risk where none exists) and false negatives (failing to detect actual risk).
- ·Guilietta does not guarantee the accuracy, completeness, reliability or timeliness of the analysis results.
- ·Users must not make critical safety decisions based solely on the platform's analysis.
- ·The analysis is not a substitute for the assessment of professionals: psychologists, lawyers, social workers or authorities.
- ·If you are in immediate danger, always call your country's emergency services (911 in the U.S., 112 in Europe or the local equivalent).
7. Safe-travel and alerts
Safe-travel mode and the alert system are support tools. Guilietta is not an emergency service, a certified safety service or a response service. We do not guarantee the delivery of alerts or the prevention of harm. You acknowledge and agree that you use the service at your own risk and that, in dangerous situations, you must contact your country's official emergency services.
- ·Guilietta is NOT a substitute for emergency services (911 in the U.S., 112 in Europe or the local equivalent).
- ·SMS delivery depends on third-party telecommunications carriers (Twilio, mobile networks) and on network conditions outside our control. We cannot guarantee that an SMS will arrive, will arrive on time or will arrive only once.
- ·Guilietta does not actively monitor your real-time location, dispatch emergency units, or operate a human response center.
- ·In case of immediate danger, always contact local authorities first. Safe-travel complements — but does not replace — that call.
- ·You are responsible for choosing appropriate emergency contacts, keeping their information up to date, and letting them know they may receive alerts.
- ·By starting a safe travel session and selecting emergency contacts, you consent to Guilietta sending transactional SMS notifications to those contacts on your behalf. You confirm that you have informed your emergency contacts that they may receive these messages. Message and data rates may apply. Recipients can reply STOP to opt out at any time or HELP for assistance.
8. Digital footprint tool
The digital footprint (digital exposure) feature lets you look up publicly exposed information associated with your own identity. It is designed solely for personal, self-protection use. By using it, you agree to the following terms:
- ·You represent and warrant that the data you enter (name, email, phone, photograph or otherwise) relates to you, or that you have the explicit consent of the data subject or a valid legal basis to process it.
- ·Using this feature to investigate, monitor, profile, harass, locate, or otherwise process the data of other people without their consent is strictly prohibited.
- ·Misuse of the tool and the entry of third-party information without proper authorization are the sole and exclusive responsibility of the person performing them. You agree to indemnify and hold Guilietta harmless from any claim, damage, or penalty —including those arising under applicable data-protection law— resulting from that use.
- ·Guilietta may suspend or terminate access for anyone who breaches this provision, without prejudice to any other legal action that may apply.
9. Plans and payments
- ·The Free plan is free and includes the basic features described on the pricing page.
- ·Paid plans (Essential and Complete) are billed on a recurring basis. Prices are subject to change with 30 days' prior notice.
- ·Payments are processed by Stripe. Guilietta does not store or have access to full credit card data. Stripe is PCI DSS Level 1 compliant.
- ·For subscriptions purchased via Stripe: no refunds are offered for partial periods. Upon cancellation, you keep access until the end of the period already paid.
- ·For purchases made through the Apple App Store or Google Play: each platform's refund policies apply.
- ·Exception: if the applicable legislation in your jurisdiction requires a withdrawal period (for example, 14 days for consumers in the European Union), that right prevails.
- ·You can cancel your subscription at any time from the "My plan" section → "Manage subscription", with no penalty.
10. Intellectual property
Guilietta and all its contents — including design, code, trademarks and text — are the exclusive property of Guilietta LLC or its licensors. You are granted a limited, personal, non-transferable license to use the service in accordance with these terms.
11. Limitation of liability
To the maximum extent permitted by applicable law, Guilietta LLC will not be liable for indirect, incidental, special or consequential damages arising from the use or inability to use the service. Our service is provided "as is" and "as available". To the maximum extent permitted by law, Guilietta LLC's total aggregate liability to you for any claim will not exceed the amount you paid to Guilietta in the twelve months preceding the event giving rise to the claim, or one hundred U.S. dollars (USD 100) if you made no payments. Some jurisdictions do not allow certain exclusions or limitations; in that case, these apply to the fullest extent permitted by law.
12. Account termination
You may close your account at any time from the profile settings. We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice depending on the severity of the violation. In the case of conduct that endangers the safety of other users, termination will be immediate.
13. Modifications
We may update these terms. We will notify you by email at least 15 days in advance of substantial changes. Continued use of the service after the notice period implies acceptance of the new terms.
14. Dispute resolution, binding arbitration and class action waiver (U.S. users)
PLEASE READ THIS SECTION CAREFULLY: IT AFFECTS YOUR LEGAL RIGHTS. For users residing in the United States, any dispute arising out of or relating to these Terms or the use of Guilietta will be resolved through binding individual arbitration and not in court, except as provided below.
- ·Prior negotiation: before initiating any formal proceeding, the parties agree to attempt in good faith to resolve the dispute by writing to hey@guilietta.com, with a 60-day period for an amicable resolution.
- ·Binding arbitration: if no agreement is reached, any dispute arising out of or relating to these terms or the service will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
- ·Seat of the arbitration: the arbitration will be conducted in English and/or Spanish, remotely or in the Florida county designated by the AAA, unless otherwise agreed.
- ·Class action waiver: you agree that any claim will be resolved only on an individual basis. You waive participation as plaintiff or class member in any class, consolidated or representative action.
- ·Small claims court exception: either party may bring qualifying claims to a small claims court of the corresponding county, instead of arbitration.
- ·Right to opt out of arbitration: you may opt out of this arbitration clause by sending an email to hey@guilietta.com with the subject "Arbitration opt-out" within 30 days of the date your account was created. Include your name, registered email and an express opt-out statement. Opting out does not affect the rest of the agreement.
- ·Regulatory complaints: this clause does not prevent you from filing complaints with regulatory or consumer protection authorities.
- ·Inapplicability: this clause does not apply where prohibited by mandatory applicable law. In particular, consumers residing in the European Union, the United Kingdom and other jurisdictions where mandatory arbitration is invalid retain the right to the competent courts of their domicile.
15. Governing law
These terms are governed by the laws of the State of Florida, United States. For any dispute, the parties agree to attempt an amicable resolution before resorting to the competent courts of the State of Florida.
16. Indemnification
To the maximum extent permitted by applicable law, you agree to defend, indemnify and hold harmless Guilietta LLC, its officers, employees, agents, contractors and licensors from and against any claim, damage, obligation, loss, liability, cost or expense (including reasonable attorneys' fees) arising from: (a) your breach of these Terms; (b) misuse of the service; (c) your violation of third-party rights, including privacy or intellectual property rights; (d) any content you submit through the service, including third-party conversations. You represent and warrant that you have the right to upload any conversation you analyze and that you have obtained the consents required by the recording and privacy laws of your jurisdiction. This obligation survives the termination of your account.
17. Force majeure
Guilietta shall not be liable for failures or delays caused by events beyond its reasonable control, including without limitation: natural disasters, fires, floods, earthquakes, pandemics or health emergencies, war, terrorism, civil unrest, governmental actions or omissions, legal changes, failures or interruptions of third-party infrastructure (including Supabase, Twilio, AWS, Stripe, Anthropic, OpenAI, Google), cyberattacks, network or telecommunications failures, strikes or any other force majeure event.
